Privacy policy

The short version

We collect three things through this website — your first name, your email address and your phone number — and only when you type them into a form. We use them to call you back about training, and to send you the emails and texts you agreed to. We do not sell your information, and we do not rent or trade it. You can have it deleted at any time by emailing info@ffagyms.com.

What we collect

Information you give us. Our forms ask for a first name, an email address and a phone number. That is the whole list. We do not ask for your date of birth, your address, your employer or your payment details anywhere on this website — if you join, any of that is collected in person, on paper, at the gym.

Information collected automatically. Like every website, ours is sent your IP address, your browser and device type, and which pages you opened. We use this to understand which pages work and which do not.

What we do not collect here. This website sets no cookies of its own and stores nothing in your browser. There is no login, no account and no shopping cart. The cookies that do get set come from the third parties listed below.

Who else receives it

This is the complete list of outside companies involved in running this site. It is generated from the site’s own configuration, so it cannot describe a service we have stopped using or omit one we have added.

• Ideas Square Lab (spamkill)

  Filters bot submissions out of our contact forms before a real lead reaches us.

  Receives

  Everything you type into a form on this site — your first name, email address and phone number — plus your IP address and browser, which is how it tells a person from a script.

  When

  Only when you submit a form. It is not loaded while you read the page.

• Keap (Infusionsoft)

  Our customer record system. It holds your enquiry and sends the emails and texts you agreed to.

  Receives

  Your first name, email address and phone number, and the record of what we sent you and when.

  When

  After a form submission passes the spam filter.

• Text Request

  The service our text messages run through. When you text 305-225-4610, this is where the message arrives so a member of staff can reply.

  Receives

  Your mobile number and whatever you text us, plus our replies. Nothing is sent unless you text the number yourself.

  When

  Only if you text us. Reading this site sends nothing to Text Request.

• Google Tag Manager

  Loads the measurement tags below. It is a container, not a tracker in itself.

  Receives

  Your IP address and browser, in the ordinary course of requesting a file.

  When

  After the page has finished rendering — deliberately last, so it cannot slow the page down.

• Google Analytics 4

  Tells us which pages people read and which ones they leave, so we can fix the ones that fail.

  Receives

  Pages viewed, time on them, approximate location from your IP address, device and browser, and a randomly generated ID that recognises a returning browser. Not your name — we do not send it there.

  When

  While you browse, once Tag Manager has loaded.

• Meta Pixel (Facebook and Instagram)

  Measures whether our Facebook and Instagram ads bring anybody here, and lets us show ads to people who visited.

  Receives

  Pages viewed on this site and, if you are signed in to Facebook or Instagram in the same browser, Meta can connect that to your account.

  When

  While you browse, once Tag Manager has loaded.

• Google Maps

  Draws the map of the gym on our location page.

  Receives

  Your IP address and browser, because the map is drawn by Google rather than by us.

  When

  When you open the location page. Every other page on this site loads no map.

• YouTube

  Hosts the videos on our pages.

  Receives

  Nothing at all unless you press play. Until then the still image comes from our own server. Press play and YouTube receives your IP address and browser, on its no-cookie domain.

  When

  Only if you press play.

• Vimeo

  Hosts the technique videos on our blog posts.

  Receives

  Nothing unless you press play. After that, your IP address and browser.

  When

  Only if you press play.

• LiveChat

  The chat window in the corner of the page, so you can ask us something without picking up the phone.

  Receives

  Whatever you type into the chat, your IP address and browser, and which page you were reading when it opened. It sets its own cookies so it can recognise you if you come back to a conversation.

  When

  After the page has finished loading, never before, so it cannot delay what you came to read. Nothing is sent to LiveChat until then.

What happens to a form submission, in order. You press submit. The form posts to Ideas Square Lab, which filters out bot traffic. What survives goes to Keap, our customer record system, which is where a real person reads it and calls you. Nothing else touches it.

How we use it

• To call or email you back about the free trial or a question you asked us.
• To send you the emails and text messages you consented to, on the terms in the next section.
• To keep our own records of who has trained here and who has enquired.
• To measure whether our advertising works, and to improve the website.

We do not sell or share your personal information in exchange for money or anything else of value, and we do not pass it to other businesses for their own marketing. We disclose it only to the service providers listed above, who may use it only to do the job we hired them for, and when the law requires us to.

Text messaging

Freestyle Fighting Academy sends two kinds of text messages, each with its own consent. (1) Informational messages - booking confirmations, replies from our staff, and account or billing notices, which you consent to when you provide your phone number on our website forms or on the documents you sign at enrollment, in each case as disclosed there. (2) Marketing messages - promotions, special offers, and events, which we send only if you check a separate, optional marketing consent box. Message frequency varies; message and data rates may apply; reply STOP to opt out or HELP for help. Consent is not a condition of any purchase. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

Phone calls. When you give us your number we may call you about your enquiry, including by automated dialling or a recorded message. Consent to marketing calls or texts is never a condition of buying anything. To stop calls, tell us on any call or email info@ffagyms.com.

Email

Marketing emails from us carry an unsubscribe link and our postal address, as the CAN-SPAM Act requires. Unsubscribing stops the marketing email; we may still contact you about something you specifically asked us about, or about your membership.

How long we keep it

Enquiries that never become memberships are kept in Keap while they are still worth following up, and deleted on request at any time. Member records are kept for as long as you train with us and afterwards for as long as we need them for tax, accounting and liability purposes. Website analytics are held by Google on their own retention schedule.

Your choices

• See, correct or delete what we hold. Email info@ffagyms.com or write to us at 1423 SW 107th Ave, Miami, FL 33174. There is no charge for this. We will need to check you are who you say you are before we hand over or delete anything.
• Stop the marketing. Unsubscribe from any email, reply STOP to any text, or tell us on the phone.
• Turn off the tracking. You can block cookies in your browser settings, install Google’s Analytics opt-out, and change your Facebook and Instagram ad settings in your Meta account. The website works normally with all of it blocked. We do not use a cookie banner because nothing on this site requires your consent to set cookies under the law that applies to us.
• Do Not Track. Browsers send this signal inconsistently and there is no agreed standard for honouring it, so we do not respond to it. This paragraph exists because Florida and several other states require us to say so plainly rather than stay silent.

Children

We teach children from the age of two, and we are glad to. This website is not directed to children and we do not knowingly collect personal information online from anyone under 13. Enrolment information about a child is given to us by their parent or guardian, in person at the gym — not through this site. The Children’s Online Privacy Protection Act (COPPA) governs online collection from under-13s, and we do not do it. If you believe a child has submitted a form here, email info@ffagyms.com and we will delete it.

Security, and what happens if it fails

We take reasonable physical, electronic and administrative measures to protect the information we hold. No website or company can promise perfect security, and we will not pretend otherwise. If a breach exposes your personal information we will notify you as the Florida Information Protection Act (Fla. Stat. § 501.171) requires — within 30 days, and notifying the Florida Attorney General as well if 500 or more Florida residents are affected.

Which laws apply to us

We are a single gym in Miami-Dade County, Florida. We are not large enough to be covered by the Florida Digital Bill of Rights, which applies to companies above a billion dollars in revenue, nor by the California Consumer Privacy Act, and we do not offer our services in Europe, so the GDPR does not apply to us either. We say this because claiming to comply with laws that do not cover you is itself misleading. The rules we actually operate under are:

• Section 5 of the Federal Trade Commission Act — a privacy policy that says something untrue is a deceptive practice. This one is written to be accurate, which is why the list above is generated rather than typed.
• The Telephone Consumer Protection Act (TCPA) and the Florida Telephone Solicitation Act (Fla. Stat. § 501.059) — we obtain your prior express written consent before sending automated marketing calls or texts, and honour opt-outs.
• The CAN-SPAM Act — every marketing email carries a working unsubscribe and our postal address.
• The Florida Information Protection Act (Fla. Stat. § 501.171) — data security and breach notification, as above.
• COPPA — as above; this site is not directed to children.

If you live in a state with its own privacy statute that does reach us, we will honour the rights it gives you. Ask us and we will not argue about jurisdiction.

This site links to other websites, including our own sibling businesses and our social media profiles. Once you follow a link you are on somebody else’s site, governed by their privacy policy and not by this one.

Changes to this policy

If we change this policy we will change the date at the top. Material changes to how we handle information already collected will be notified to members by email.
